1. ENTRY PERIOD: The “Alaska Wildlife Photo Contest” contest (the “Contest”), sponsored by Holland America Line N.V. (“Sponsor”), begins at 12:00:01 a.m. Pacific Time (“PT”) on May 8, 2024 and ends at 11:59:59 p.m. PT on July 31, 2024 (the “Entry Period”). Sponsor is the official timekeeper for the Contest.

2. ELIGIBILITY: The Contest is open only to legal residents of the fifty United States and the District of Columbia who are 21 years of age or older and are located in an eligible jurisdiction as of the time of entry (“Entrants”).  Employees of Sponsor, any administrators assisting in the execution of the Contest, and each of their respective parent companies, subsidiaries, affiliates, distributors and advertising and promotion agencies (all of the foregoing, the “Contest Entities”), and such employees' immediate family (spouse, parent, child, siblings and their respective spouses) and household members (whether related or not), are not eligible to enter or win. The Contest is subject to all applicable federal, state, and local laws and regulations and void in U.S. territories and where prohibited by law. Sponsor's decision is final in all matters relating to this Contest. Those who do not follow any or all of Sponsor’s instructions, these Official Rules and/or provide all required information in their entry may be disqualified.  

3. HOW TO ENTER: 

Participation Requirements: To participate, you will need to have a personal, public Instagram account. Creating an Instagram account is free but is subject to the applicable terms and conditions (http://instagram.com/about/legal/terms/#). If entering via a mobile device and using your wireless carrier’s network, standard data charges from your wireless carrier may apply. 

Entry Requirements: To enter, during the Entry Period, an eligible Entrant may post an original photograph to the static feed of their Instagram account and use hashtags #HollandAmericaWildlife and #ContestEntry (the “Entry”). In addition, by entering, you affirm your assent to these Official Rules (the “Rules”).  Instagram Stories and Instagram posts where the hashtags are included in a comment rather than the caption of the original post will not be deemed Entries. Your post need not include any reference, positive or negative, to Sponsor’s products or services. Including such a reference in your post will not improve your chances of winning. Your post must also comply with the Entry Guidelines and Restrictions listed in Rule 4 of these Official Rules. You must not change your Instagram handle once you have posted your Entry and until the prize is awarded. Your account settings must remain public until the prizes are awarded. The Social Account post and hashtags, along with anything else submitted by Entrant in connection with the Contest, shall be collectively referred to herein as the “Entry.” Where your Entry meets all requirements, it will be deemed one (1) Contest entry.

Proof of submission does not constitute proof of entry. Entry times will be determined using the Sponsor’s computer, which will be the official clock for the Contest. There is a limit of one (1) Entry per person/Instagram account. If Sponsor discovers more than one Entry from the same person or Instagram account, all but the first Entry received will be void. In the event of a dispute regarding any Entry, the Entry will be deemed made by the authorized account holder of the Instagram account used at the time of entry. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses used to create the Facebook or Instagram account. The potential winner may be required to show proof of being the authorized account holder. Released Parties (as defined in Section 10, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed, or misdirected Entries or failure to receive Entries due to limitation of third-party social network platforms; all of which will be void.  All Entries become the property of the Sponsor and will not be returned, verified or acknowledged.  

By submitting an Entry, each Entrant agrees, represents, and warrants that his/her Entry conforms to the entry guidelines and restrictions set forth in Rule 4 of these Official Rules (“Entry Requirements”). Without in any way limiting, expanding or amending the requirements set forth in these Official Rules, which terms and conditions shall remain in full force and effect, if Sponsor is duly notified that any element of an Entrant’s Entry infringes upon the rights of another person, receives a legally valid request to remove the affected Entry from any of Sponsor’s social media sites, websites or forums (as authorized herein) because of such infringement, and/or deems any element of an Entry to not be in compliance with any other Entry Requirement set out below,  such Entry may be disqualified from the Contest, as Sponsor may determine in its sole discretion. Further, each Entrant hereby agrees to indemnify and hold Sponsor and the Contest Entities harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any actions arising out of the authorized use of the Entry hereunder (including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever).

4.  ENTRY GUIDELINES AND RESTRICTIONS: In order for an Entry to be eligible hereunder, it must meet the following criteria (all as determined by the Sponsor in its sole and absolute discretion):

• Entry must be the unique and original work of Entrant and must not be copied from another source/plagiarized or have been previously published.

• Entry must comply with these Official Rules.

• Entry must not contain material that violates or infringes another's rights, including, but not limited to, privacy, publicity or intellectual property rights, including copyright infringement (including, but not limited to logos, trade names, or patented features).

• Entry must be in keeping with Sponsor’s image and not be offensive or disparaging to Sponsor or any other person or party. 

• The Photograph must not include any likeness or personally identifiable information of any person, such as full name, address or phone number.

• Entry must not include any logos, brand names or trademarks other than Sponsor’s, which Sponsor has granted entrant a limited license to use within a Photograph for purposes of this Contest.

• The Entry must not have been submitted previously in a promotion or contest of any kind;

• Entry must not contain material that is inappropriate, indecent, lewd, pornographic, obscene, hateful, violent, tortious, defamatory, slanderous or libelous (as determined by Sponsor at Sponsor’s sole discretion);  

• Entry must not contain, facilitate, reference, or use material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, ethnicity, religion, nationality, disability, sexual orientation, political orientation, citizenship, ancestry, marital status, or age (as determined by Sponsor at Sponsor’s sole discretion); 

• Entry must not contain any express or implied commercial endorsement.

• Entry must not contain, facilitate, reference, or use material that promotes illegal drug use, alcohol abuse, use of alcohol by minors, tobacco use, firearms/weapons, any political agenda or message, or any illegal activity.

• Entry must not contain any viruses, spyware, malware, or other malicious components that are designed to harm the functionality of a computer in any way. 

• Entry must not contain material that is unlawful, in violation of or contrary to the laws, statutes, ordinances, policies or regulations in any jurisdiction where Entry is created or in any jurisdiction where the Contest is open.

NOTE: By submitting an Entry, each Entrant agrees, represents and warrants that his/her Entry conforms to the Entry Requirements set forth above and all other terms and conditions in these Official Rules and that Sponsor may, at its sole and absolute discretion, disqualify him/her from the Contest if Sponsor (in Sponsor’s sole discretion) decides that his/her Entry fails to conform to the Entry Requirements or any other provision of these Official Rules.

5.  JUDGING AND SELECTION OF THE WINNERS:  There will be two rounds of judging in the Contest. 

A. Round 1 Judging:  Round one judging will be conducted by a panel of judges as determined by Sponsor (“Round 1 Judging”) based on the following judging criteria: originality (25%); species and habitat diversity (25%); and quality of photograph (50%).  During Round 1 Judging, the judges will review each Entry received and assign a score, based on the criteria above. The three (3) Entries that receive the highest overall scores will be named the finalists (each a “Finalist” and collectively the “Finalists”). In the event of a tie, the person among the tied entrants with the highest score in Alaska inspiration will be the winner of the tie. Round 1 Judging is scheduled to be completed on or about August 15, 2024.

B. Round 2 Judging: Round two judging of the three Finalists will be conducted by Sponsor representatives (“Round 2 Judging”) based on the following judging criteria originality (25%); species and habitat diversity (25%); and quality of photograph (50%). During Round 2 Judging, the judges will review each Finalist Entry and assign a score, based on the criteria above. The Finalist that receives the highest overall score during the Round 2 Judging will be named the “Grand Prize Winner” (subject to verification), and the remaining Finalists will each be named a “First Prize Winner” (subject to verification). In the event of a tie, the person among the tied entrants with the highest score in Alaska inspiration will be the winner of the tie.

In no event will there be more than three (3) Finalists, only one of which will be named the Grand Prize Winner. All First Prize Winners and the Grand Prize Winner are considered potential winners pending verification of eligibility and compliance with these Official Rules.  Together the one Grand Prize Winner and two First Prize Winners shall be referred to collectively as the “Winners.” Round 2 Judging is scheduled to be completed on or about August 31, 2024. For Canadian residents: the odds at each level of judging depend on the number and calibre (based on the judging criteria) of eligible Entries received (this should not be interpreted that the results are based on chance).

Sponsor reserves the right not to select a winner if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Entries. Sponsor will not disclose judging scores.

6. PRIZES: One (1) Grand Prize and two (2) First Prizes are available to be awarded in the Contest, for a total of three prizes (each a “Prize” and collectively the “Prizes”). Limit one Prize per household. 

A. Grand Prize description: One (1) Grand Prize Winner will be receive an up to seven (7)-day Holland America Line 2025 Alaska cruise roundtrip Seattle, Washington or Vancouver, B.C., Canada, of winner’s choice (subject to availability at time of booking) for the winner and one (1) guest, sharing accommodations in a Verandah Suite (“Cruise”). There is no guarantee that the Grand Prize Winner will receive their first choice Cruise, and such Winner waives all liability related to not receiving their first choice. The approximate retail value (“ARV”) of the Prize is $1,500 USD.

B. First Prize description: Two (2) First Prize Winners will each receive one (1) USD$250 Holland America Line gift card for the winner. Gift cards are subject to the terms, restrictions, and conditions as set forth thereon. The approximate retail value (“ARV”) of the Prize is $250 USD. 

Total ARV for all Prizes available to be awarded in this Contest: $2,000USD.

The Grand Prize includes the cruise fare’s taxes, Fees, and Port Expenses (Grand Prize does not include federal income taxes). Grand Prize consists of (i) stateroom accommodations for the Winner and one (1) guest, sharing accommodations of one stateroom as stated in prize description (stateroom upgrades require payment of a fee, upgrade cost is calculated based on each category and is subject to change), and (ii) most shipboard meals (certain alternative dining options require payment of a fee). For certainty, the Winner and guest are solely responsible for any airfare and/or other transportation expenses required to travel to and from the applicable cruise departure point. Prize is only redeemable for 2025 Alaska sailings through October 31, 2025. Additional restrictions and blackout dates may apply. All Prize details, including stateroom category, will be determined by Sponsor at its sole discretion. Winner and guest must travel together on the same itinerary.  Guest of winner must not be a minor in their state of residence unless the Winner is the parent or legal guardian of such minor guest, in which case the Winner must always accompany such minor guest during the trip (including, but not limited to prize activities and other prize related events).  Prize travel must be completed by October 31, 2025 or Prize will be forfeited. Prize travel date and arrangements are subject to availability at the time of booking. No alternate travel dates are available. Once scheduled, the Prize itinerary cannot be altered and failure of Winner to follow such itinerary shall not obligate Sponsor in any way to provide such Winner with alternate arrangements. All expenses and costs associated with the acceptance or use of the Prize that are not expressly specified in these Official Rules or by Sponsor, in photograph, as being part of the Prize (including without limitation airfare, ground transportation, luggage fees, hotel accommodations, shore excursions, travel insurance, medical insurance, COVID-19 test expenses, laundry service, spa treatments, alcoholic beverages, alternative dining, gratuities, local and long distance telephone calls, ship to shore communications including Internet usage, merchandise, and souvenirs, incidental expenses, hotel service charges, personal onboard expenses, or applicable passport, visa and entry/exit fees) are the sole responsibility of the Winner and guest. First Runner Up Prizes consist of a $250 USD Holland America Line gift card. Gift cards may be used for purchases on board Holland America Line vessels or applied as payment to a Holland America Line cruise booking. This card may not be redeemed for cash, unless required by law. Holland America Line does not accept responsibility for cards lost, damaged or stolen, or any unauthorized use of cards. Acceptance and/or use of this card constitutes acceptance of these terms and conditions, which may change at any time. 

Prizes are provided subject to each Winner and their guest’s agreement to comply with the Holland America Line Cruise Contract and the terms and conditions set forth in the applicable Holland America Line brochure.  Each Winner and guest agree to comply with all applicable cruise regulations and the each Winner and adult guest must individually read, accept and sign the Cruise Contract and the Covid-19 Risk Acceptance on his/her own behalf and on behalf of any eligible minor guest. These documents are required before boarding. 

Prizes are non-transferable, non-refundable, non-negotiable for cash, may not be resold, and cannot be used as partial payment toward a different Holland America Line cruise or stateroom category other than that assigned or used in conjunction with any other offer or promotion, except at the sole discretion of Sponsor. Winner and guest are NOT eligible for Holland America Line’s air/sea or Cancellation Protection Plan programs in connection with their Prize. Winner and guest are responsible for obtaining travel and medical insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not, and will not, obtain or provide travel or medical insurance. No substitution of a Prize or any component thereof is permitted, except in the discretion of Sponsor, who reserves the right to substitute a Prize or Prize component with a substitute prize of equal or greater value (including without limitation if the fulfilment of the Prize, or any part thereof, is rendered impossible, infeasible, unsafe or impractical for any reason including without limitation due to any COVID-19 or other pandemic-related law, regulation, order, policy, guideline, strike, travel restriction, venue policy, restriction, or for any other reason). Prizes will be awarded only to Winners with a residential address within the 50 United States or the District of Columbia, or within Canada (excluding Quebec). ARVs of Prizes are based on applicable information at time Official Rules were drafted.  Prize value depends on actual cruise booked and market conditions at time of fulfillment. Winner will be solely responsible for all applicable income taxes, if any, connected with acceptance of Prize. As a condition of accepting the Prize, as applicable, the Winner agrees to furnish to Sponsor any requested information needed for tax reporting, including IRS Form W-9, and understands that such information must be received by Sponsor before or at the time any Prize is issued to or booked on behalf of such Winner. As applicable, Winner will receive an IRS Form 1099 for the actual value of the prize awarded. Fair market value of Prizes may be reported for tax purposes where required by law. The difference in value of Prize as stated herein and value at time of notification, if any, will not be awarded. Prize will be awarded if validly claimed by the date specified in the Prize award notification. Guest accompanying Winner must sign and return release of liability/publicity prior to booking travel. Once travel guest is selected, they may not be substituted, except in Sponsor’s sole and absolute discretion. Winner and guest are responsible for all required and necessary identification and travel documents including providing proper citizenship documentation to travel, which may include passports, valid alien registration card and/or necessary visas, as well as for obtaining and providing proof of any and all required (either by applicable government, port or Sponsor’s own) Covid-19 or any other vaccination, testing or health protocols in advance or at time of boarding the cruise/cruisetour vessel (originally or after any excursion), at Winners/guests sole cost.  Those without proper citizenship health/vaccine protocols and documentation will be denied boarding. Sponsor will not be responsible if Winner/guest are denied entry onto ship, into various ports during the cruise, or return entry into departure point. In such a situation, the Winner/guest will be responsible for any and all additional costs incurred. Each traveler must check with their travel advisor, government agencies, embassies or consulates prior to their vacation to ensure that they have proper citizenship documentation. U.S. Citizens can also visit the State Department's travel website at www.travel.state.gov for more information. U.S. travelers of all ages are strongly encouraged to obtain passports. Prize elements may not be separated. Winner and guest must obey all ship and cruise rules and requirements, and failure to follow such rules and requirements may result in, without limitation, forfeiture of all or part of the Prize. Lost, stolen or damaged cruise tickets or any other ticket or certificate in connection with Prize will not be replaced or exchanged. Sponsor reserves the right to remove or to deny entry to Winner and/or guest in the event Winner and/or guest, in Sponsor’s sole discretion, engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or engage in any other objectionable behavior. Sponsor and all other Released Parties (defined below) shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by any air carriers, hotels, venue operators, transportation companies, or any other persons in connection with Prize. Without limiting the foregoing, the Sponsor and all other Released Parties (defined below) will not be in any way responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of the Prize is delayed, postponed, re-scheduled or cancelled for any reason whatsoever (including, without limitation, due to illness or health risks, or any governmental or health authority orders, measures, directives or guidance in response to such illness or risks, such as, without limitation, those that may be implemented to mitigate COVID-19 transmission, or due to any other cause of any kind or nature whatsoever). Additional prize award details and travel information may be provided to Winner at the time of notification and/or booking.

7. WINNER NOTIFICATION AND VERIFICATION: Potential winners will be notified by Instagram direct message, on or about August 31, 2024 (“Winner Notification”).  An Affidavit of Eligibility, Liability Release and Publicity Release (“Prize Claim Forms”) will be attached to the Winner Notification. Before being verified as a Winner, each potential winner must complete, sign and return the Prize Claim Forms (where legal) to Sponsor, within five (5) days of the send date of the Winner Notification. If the Winner Notification is returned as undeliverable, or if a potential winner fails to complete, sign and/or return any required Prize Claim Forms within the required time period, or if the Sponsor determines that a potential winner is ineligible, or if a potential winner does not otherwise comply with these Official Rules and/or cannot accept Prize as awarded for any reason, such potential winner may be disqualified and an alternate potential winner may be selected (the next highest scoring Entrant) even if the disqualified potential winner’s name has already been publicly announced, in Sponsor’s sole discretion. Sponsor is not responsible for any change of Instagram Handle of any Entrant. Potential winners must comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements.

8. PUBLICITY RELEASE: Except where prohibited by law, by accepting a Prize, each Winner grants  permission to Sponsor and the Contest Entities, and those authorized by any of them, to use such Winner’s name, likeness (including without limitation photographs and/or recordings of the Entrant), voice and biographical information, for purposes of trade, publicity or promotion and any other purpose, in all media and formats, whether now known or later developed, throughout the world in perpetuity, without any notice, permission or compensation (except where prohibited by law). Sponsor may in its discretion create and disseminate blog posts and other informational accounts of the Prize and the activities of the Winner and guest in connection with the Prize, and by entering and/or accepting a Prize, each Winner consents to the same.

9. GRANTS OF RIGHTS IN ENTRIES:  

1. By Entrants: By submitting an Entry in this Contest, each Entrant agrees that Sponsor and Contest Entities, and those authorized by them (collectively “Authorized Users”) have the exclusive right and license, but not the obligation, to post, use and/or otherwise display and exploit their Entry, in whole or in part, edited or unedited, and with or without identifying the Entrant’s name, on the following: the Website, Sponsor’s other websites or social media accounts, the judge’s website or social media sites (“Contest Media”) during the Contest Period worldwide and for a period of three weeks thereafter (“Posting Period”) as winners are verified and finalized.  The Authorized Users have no obligation to take down their posts after the Posting Period. If an Entry is displayed in or on the Contest Media, the Entry may be subject to third party comments that will be publicly viewable, and further, such Entry may also be saved, shared, and/or further emailed by such third parties on the internet or otherwise, and Sponsor and the other Contest Entities shall have no liability for such third-party actions.  Further, Sponsor, at its sole discretion, may add or remove any Entry from the Contest Media at any time for whatever reason. By submitting an Entry in this Contest, each Entrant waives all moral rights in and to his/her Entry (and each component thereof) in favor of the Authorized Users. The displaying of an Entry on the Contest Media does not constitute verification of eligibility or compliance with these Official Rules and is no indication of Sponsor’s or any judge’s opinion about such Entry.  Likewise, the fact that an Entry does not appear on any Contest Media is not an indication that such Entry has not been validated or is not a contender in the Contest.

    

2. By Winners: To the fullest extent permitted by law, by submitting an Entry in this Contest and accepting a Prize, each Winner irrevocably assigns and transfers to the Sponsor any and all rights, title and interest in and to their Entry, including but not limited to any and all intellectual property rights (including copyright and trademark rights) and goodwill associated therewith, and such Winner agrees never to thereafter challenge Sponsor's ownership of the Entry. Each Winner agrees, upon the Sponsor’s request, to sign any further document(s) as may be deemed necessary by the Sponsor in its sole and absolute discretion to perfect, or give full effect, to such assignment. Without limiting the foregoing, each Winner acknowledges and agrees that by submitting their Entry, he/she grants to the Sponsor the exclusive right and license (but not the obligation), to use, reproduce, publish, adapt, display, make derivative works of or from, communicate to the public by telecommunication, register for copyright/trademark protection, assign, sell, sublicense, edit, dispose of, and/or modify or otherwise exploit their Entry, in whole or in part, in any way, and the option (but not the obligation) to identify the Winner by name as the author of the Entry, in commerce for any purpose whatsoever and in any and all media, whether now known or hereafter conceived, worldwide, in perpetuity, without limitation, notification or compensation to the Winner.  As part of the winner verification process, a potential winner will be required to sign an agreement to that effect.  By submitting an Entry, each Winner irrevocably waives any and all so-called moral rights he/she may have in and to his/her Entry (and each component thereof) in favor of the Sponsor (and anyone authorized by the Sponsor to use such Entry).

GENERAL CONDITIONS: Sponsor, Contest Entities, Facebook, Inc., Instagram, Inc., and the successors, assigns and agents of each of the foregoing, and each of their respective directors, officers, representatives and employees (collectively, the “Released Parties”) are not responsible for, and will have no liability for, late, lost, delayed, illegible, damaged, corrupted or incomplete entries, incorrect or inaccurate capture of entries or entry information, loss of or damage to entries or entry information, or any other human or technical errors of any kind relating to the operation of the Website or social media sites, including, but not limited to errors in connection with any computer systems, phone lines, hardware, software or computer or network connections, communications or attempted communications with any Entrant, the submission, collection, storage or processing of entries or the administration of the Contest. The Released Parties are not responsible for, and will have no liability for, undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user's Internet service provider and/or e-mail client or for insufficient space in user's e-mail account to receive e-mail. The Released Parties are not responsible for, and will have no liability for, any damage to any computer or computer system resulting from participation in or accessing or downloading information in connection with this Contest. The Released Parties are not responsible for, and will have no liability for, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause any postponement or cancellation of Prize or any component thereof. Sponsor is not responsible for, and shall not have any liability for, any typographical or other error in the printing of the Official Rules or any advertising and/or promotion materials in connection with Contest, administration of the Contest or in the announcement of any Prize. In no event will more than the stated number of Prizes be awarded. Use of any macro, “bot” or other automated system or mechanism to submit entries is prohibited and any such entries will be disqualified. Entrants may not register with multiple email addresses nor may Entrants use any other device or artifice to register multiple times or as multiple registrants. Any Entrant who attempts to enter with multiple email addresses or social media accounts under multiple identities or uses any device or artifice to register/play multiple times will be disqualified and forfeits any and all prizes won, in Sponsor's discretion. Sponsor, in its sole discretion, may disqualify any individual (and all of Entrant’s entries) who tampers with the entry process. Sponsor may prohibit any individual from participating in the Contest or winning a Prize if, in Sponsor’s sole discretion, it determines or believes that such individual (a) attempts to undermine the legitimate operation of the Contest by cheating, hacking, deception or other unfair playing practices, (b) acts in a manner that is intended or likely to annoy, abuse, threaten or harass any other Entrant or any representative of Sponsor, or (c) acts in violation of these Official Rules. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend all or part of this Contest should a virus, bug, Entrant fraud or misconduct, or other cause(s) beyond the reasonable control of Sponsor, in Sponsor’s sole determination, corrupt the administration, integrity, security or proper operation of the Contest. In the event of termination of the Contest, a notice will be posted online and a random drawing to award the Prize(s) will be conducted from among all Eligible Entries received prior to the date of termination if a sufficient number of non-suspect entries have been received. By participating in this Contest, Entrants agree (i) to be legally bound by the Official Rules and the decisions of Sponsor, which are final and binding in all respects; and (ii) that the Released Parties have not made, with respect to Prize or part thereof (if applicable), any warranty, representation or guarantee, express or implied, in fact or in law, with respect to the prize and specifically disclaim all such warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. 

Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. If any provision of the Official Rules is determined to be invalid or otherwise unenforceable, then the Official Rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Should a Winner make any false statement(s) in any document referenced above, the Winner may be required to promptly return Prize to Sponsor, or the cash value thereof, as applicable.

CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAW. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. 

11. LIMITATION OF LIABILITY AND RELEASES: AS A CONDITION OF ENTERING, ENTRANTS AGREE (AND AGREE TO CONFIRM IN PHOTOGRAPH IF REQUESTED), THAT THE RELEASED PARTIES SHALL HAVE NO LIABILITY WHATSOEVER FOR ANY DAMAGE OR LOSS TO PERSON OR PROPERTY OR ANY OTHER LIABILITY DUE, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, TO THE OPERATION OF THIS CONTEST, ANY PERSON'S PARTICIPATION IN THIS CONTEST, AND/OR THE ACCEPTANCE, POSSESSION, RECEIPT, USE AND/OR MISUSE OF ANY PRIZE OR PRIZE COMPONENT (INCLUDING WITHOUT LIMITATION ANY PRIZE-RELATED TRAVEL), AND/OR USE OF THE WINNER’S NAME, LIKENESS, VOICE AND/OR BIOGRAPHICAL INFORMATION AS PERMITTED HEREUNDER, INCLUDING, WITHOUT LIMITATION, ANY CLAIMS OR LIABILITY RELATING TO LOSS OF OR DAMAGE TO PROPERTY, PERSONAL INJURY, ILLNESS  AND/OR DEATH, PERSONALITY, PRIVACY RIGHTS OR DEFAMATION. ENTRANTS ASSUME ALL LIABILITY FOR ANY INJURY OR DAMAGE CAUSED, OR CLAIMED TO BE CAUSED, BY PARTICIPATION IN THIS CONTEST OR THE ACCEPTANCE, RECEIPT OR USE OF ANY PRIZE OR PRIZE COMPONENT. BY ACCEPTING PRIZE, WINNER, AND WINNER’S GUEST, (I) SIGNIFY THAT THEY UNDERSTAND, ACKNOWLEDGE AND ACCEPT THAT PARTICIPATION IN THE PRIZE MAY INVOLVE DANGER AND/OR EXPOSURE TO RISKS AND HAZARDS, INCLUDING WITHOUT LIMITATION AS MAY BE DUE TO THE INHERENTLY DANGEROUS NATURE AND RISK IN LAND AND SEA TRAVEL AND AS MAY BE DUE TO POSSIBLE COVID-19 EXPOSURE OR INFECTION, WHETHER ARISING FROM FORESEEABLE OR UNFORESEEABLE HUMAN ERROR AND NEGLIGENCE, AND THAT, AS A RESULT, WITHOUT LIMITATION, WINNER AND/OR WINNER’S GUEST MAY SUFFER, WITHOUT LIMITATION, DAMAGE TO PERSONAL PROPERTY, PERSONAL INJURY, ILLNESS AND/OR DEATH, (II) SIGNIFY THAT THEY ACKNOWLEDGE AND AGREE THAT THE RELEASED PARTIES HAVE NOT MADE ANY WARRANTIES, GUARANTEES OR REPRESENTATIONS ABOUT THEIR SAFETY WHILE PARTICIPATING IN THE PRIZE; AND (III) WARRANT AND REPRESENT THAT THEY HAVE EVALUATED THE NATURE, SCOPE, AND EXTENT OF THE RISKS INVOLVED, ACKNOWLEDGE THAT THEIR PARTICIPATION IN THE PRIZE, OR ANY ASPECT OF THE PRIZE, IS VOLUNTARY, ACKNOWLEDGE THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES THEY ARE PARTICIPATING IN AND THEY FREELY AND VOLUNTARILY AGREE AND ASSUME ANY AND ALL RISK OF SUCH FACTORS AND OCCURRENCES AND AGREE THAT SPONSOR, CONTEST ENTITIES AND RELEASED PARTIES SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY, ILLNESS AND/OR DEATH.  

Entrants further understand and agree that all rights under Section 1542 of the Civil Code of California (“Section 1542”) and any similar law of any state or territory of the United States that may be applicable with respect to the foregoing release are hereby expressly and forever waived. Entrants acknowledge that Section 1542 provides that: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.” The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. 

12. PRIVACY: Sponsor and Contest Entities and their respective contractors, agents and licensees will have the right to process, store, disclose and otherwise use all data provided to the Sponsor in connection with this Contest, including but not limited to each Entrant’s name, Instagram handle, and email address, for the purpose of administering the Contest. Personal data will be transferred to Sponsor and Entrants consent to the data transmission, processing and storage of this personal data in the United States by the entities and for the purposes as mentioned herein, and as provided in the Sponsor’s (www.hollandamerica.com/en_US/legal-privacy/privacy-policy) and Administrator’s privacy policies. Entrants are providing information to Sponsor and not to Facebook. 

13. DISPUTES: Except where prohibited by law, as a condition of participating in the Contest, each Entrant agrees (and agrees to confirm in photograph) that: (a) any and all disputes, claims and causes of action arising out of or connected with this Contest or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a court of proper jurisdiction located in King County, Washington, USA; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees or court costs; and (c) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and waives any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of the Entrant in connection with the Contest, or the conduct of the Contest shall be governed by, and construed in accordance with, the laws of the State of Washington, USA, without giving effect to any choice of law or conflict of law rules (whether of the State of Washington, USA or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington. By entering, Entrants consent to the jurisdiction and venue of the federal, state and local courts for King County, Washington, USA.
